FITCHBURG, Mass. — A college student accused of killing his childhood friend while driving drunk has been held on $2,500 bail after a court hearing in Fitchburg Monday.
Joseph Kapp has also been ordered to remain drug and alcohol free and is not allowed to drive.
Police say the 19-year-old was driving drunk when he lost control of his car and hit several trees early Saturday morning, killing Austin Robbins, 18, and injuring Sean McNiff, 19.
”I just wish this never really happened. I wish for my buddies to be back.” McNiff told FOX25's Crystal Haynes. ”Most of us are definitely hurting. And we’re not angry at Joey or anything. We’re angry at just what happened. And not necessarily Joey. Because we do love Joey still.”
In court, prosecutors said Kapp had a blood alcohol concentration of 0.12 and failed field sobriety tests.
The assistant district attorney said the three friends were partying at Fitchburg State and were on their way home when the crash happened.
"He admitted to drinking at a party at Fitchburg State [University]. He admitted to having four to five Twisted Teas. He admitted to speeding. He admitted to trying to show off,” ADA Antony Melia said.

Defense attorney Patrick Burke say they have no evidence of any admission.
"My client never indicated that he made any statements to the police,” Burke said.
Defense attorneys say Kapp, who is a a scholarship student at Boston University, is sorry for what happened.
