Prosecutors said that the pair kicked, punched and urinated on a 58-year-old homeless man sleeping near the JFK/UMass MBTA station. One of them allegedly struck the victim with a metal pole repeatedly. The brothers then "walked away laughing," according to witnesses.
The victim was treated at Boston Medical Center for a broken nose, serious bruising across his torso and other injuries.
Prosecutors said that Scott Leader made a series of incriminating statements at State Police barracks, including that he and his brother "tuned up" an "illegal immigrant," and that this behavior was acceptable because the victim was homeless and Hispanic.
The defendants' Superior Court arraignments have not yet been scheduled. Their next court date in Dorchester is Dec. 9.
