CANTON, Mass. — A new zip-line and climbing park in Canton is getting rave reviews from visitors, but not all neighbors feel the same joy.
One man has filed a lawsuit against TreeTop Adventures threatening to shut the park down for complaints of excessive lights and noise.
“It would crush us financially,” TreeTop Adventures owner Topher Kerr said.
Kerr has already taken steps to address the neighbor's complaints about excessive lights and noise, including installing a giant curtain to block the lights and closing earlier on Fridays and Saturdays. Sound engineers were also hired to see what else can be done to keep noise down.
“We are ready to work with the neighbors, we have reached out, we continue to try and do that,” Kerr said.
Kerr makes that pledge despite the fact he says he did everything the town required to get the park plan approved. It turns out it was an error of omission by the town that is now tripping treetop adventures up.
In Canton, people who live near a proposed project are supposed to be kept informed what's going on in case they have any complaints or concerns. The town provided that list of abutters for the proposed zip-line park, but Kerr says it somehow left off the one house you can see right through the trees.
The owner of that one home filed a lawsuit against the park. He initially agreed to speak with Boston 25 News but later failed to respond to phone calls.
Kerr and his wife molly went for broke to open the park, selling their house and moving, and say the prospect of losing it is unfathomable.
“It keeps me up at night. But I don't want to talk about it. We're going to figure this out,” he said.
