Relatives of alleged Falmouth shooter face charges in court

FALMOUTH, Mass. — Two people related to the man accused of shooting two Falmouth Police officers were in court Monday.

The mother and brother of Malik Antonio Koval, 21, were charged with assault and battery on a police officer, intimidation of a witness/police officer and interfering with the duties of a police officer.

Officers Donald DeMiranda and Ryan Moore were responding to a disturbance call Friday on Ashley Drive in East Falmouth where according to reports, they found Malik Koval breaking bottles in the street.

According to the Cape and Islands District Attorney’s office, as Malik Koval ran from the officers into his home, his mother, Kimberly Koval and his brother, Marcus Maseda, tried to stop the officers.

The Koval family's attorney, however, said they were trying to help police.

"She saw Malik running out, and she went and actually tackled Malik to the ground and held him there until the police officers came and dealt with him at the time," the attorney said.

Police say Koval then grabbed a gun and began firing at the officers. One bullet grazed Officer Moore's neck. Another hit Officer DeMiranda in the chest but was stopped by his bulletproof vest, and yet another round struck him just above the vest.

Officer DeMiranda was scheduled for surgery Monday afternoon to have a bullet removed, Falmouth Police Chief Ed Dunne said.

Dunne said he spoke to DeMiranda Monday morning and the officer is in good spirits, with his family.

Officer Moore, is resting at home, Dunne said, and thanks everyone for their thoughts and prayers.

Some officers from the department will likely be at Monday's arraignment, Dunne said.

Malik Koval is in police custody at Brigham & Women’s Hospital in Boston. He was shot several times during the incident and is expected to recover.

Boston 25 News found the alleged shooter once led police on a high-speed chase and failed to appear for his arraignment to answer the charge.

Police in Westerly, Rhode Island, tried to stop Malik Koval for speeding on November 25 last year, but he refused to stop, leading them on a brief, high-speed chase, according to court documents.

He was arrested and released on $100 bond and was scheduled to be arraigned in Rhode Island last December on a charge of eluding law enforcement vehicle in a high-speed pursuit. He did not appear in court, and a warrant was issued for his arrest.

The suspect's arraignment for the shooting in Falmouth has not yet been set.
