Man accused of sexual assault arrested again while out on bail

QUINCY, Mass. (MyFoxboston.com) -- A local woman wants to know why the man she says sexually assaulted her isn't behind bars after he allegedly broke the law again.

Fox 25 News does not identify victims of sexual assault.

The woman says she's watched her case work through the courts now for two years. She says she was devastated when she learned the suspect in her case was arrested again, accused of hurting someone else

"My next court date's in May. What's going to happen between now and May is the question," the woman told FOX25's Kerry Kavanaugh.

The woman says the court system is letting her down and potentially putting others at risk.

"I don't want to happen to anyone else again," she said.

Tuesday, the woman was back in Quincy Municipal court with the man accused of assaulting her.

Vincent Agostino, of Hull, faces two counts of indecent assault and battery in her case.

The woman told us it happened when she and her children became homeless in 2013, and the state placed her family in a Super 8 Motel in Weymouth. She says Agostino was a maintenance worker there.

"And he came and knocked on my door and said that he had to fix the AC," she said.

Court records say that's when Agostino walked into the room.

"I asked him to leave and he got up and he sexually assaulted me four times,” the woman said.

That was May, 2013. He's been out on bail ever since, despite getting arrested again.

"The victim witness advocate called me to let me know he was arrested for rape and assault and battery as well as disorderly conduct,” she said.

The Plymouth District Attorney's office told FOX25 News the rape charge has been dismissed. The other charges stand.

Despite his pending case in Quincy Municipal Court, the district attorney's office says a Plymouth district judge granted him another bail.

"They keep letting him walk out of these doors and you know, it can happen to anybody,” The woman said. "It almost ruined my life."

The suspect is due back in court for both cases in May. Kavanaugh called Agostino's defense attorney for comment. FOX25 will update this story when we hear back.
