Trial underway for former IRS agent accused of raping intern

BOSTON — The trial is underway for the former IRS agent accused of raping a 21-year-old intern at gunpoint and allegedly using his government-issued gun and handcuffs to commit the crime.

On Monday, a Boston Police detective showed the jury the gun prosecutors say former IRS agent James Clarke used to rape the 21-year-old intern. Prosecutors say Clarke allegedly handcuffed her inside his government vehicle before raping her, but he says their after-work encounter was consensual.

“Nobody expects to have a gun put down their throat and to be raped and handcuffed into a car. That’s not what hooking up is," the victim said Monday.

Prosecutors say Clarke, who is married with three children, invited the intern out for drinks near the IRS office in Government Center in July 2017. After a number of drinks, prosecutors say Clarke handcuffed the woman inside his government car, put his gun into her mouth, and raped her in a parking garage and again, outside of South Station.

The frantic 911 call was played in court Monday.

Dispatcher: So he put the gun in your mouth and sexually assaulted you?

Victim: Yes

Dispatcher: He said he works where?

Victim: He works for the IRS

The trivia host at the bar where they were drinking told the jury what she said Clarke did that night.

“He moved his shirt to the side and showed me his gun. You and I both know you can’t show me that in public, that is an incite to start a riot. And then he showed me his badge and said I can do what I want," said Amie Rogers.

The trial resumes Tuesday morning.
