BOSTON (MyFoxBoston.com) – A Taunton mom says her 4-year-old daughter was banned from daycare because she was recently diagnosed with diabetes.
Carmen Batista says her diabetic daughter can no longer attend the Bristol-Plymouth child care center because the school doesn't believe it would be safe for her.
"And now I have to tell my daughter you can't go there, you can't go to school because you have that illness," Batista said.
The young girl has reportedly been attending the school for a year and a half, but was just diagnosed with diabetes two weeks ago. Batista met with the director of the daycare for what she thought was a planning meeting to go over her daughter's care; she believed the school nurse would give her daughter one insulin shot every day during her lunch break, but school officials were not on the same page.
âLater that day, we received a phone call from the director of the school saying they didn't feel comfortable taking her back, and the nurse thought it wasn't on her contract to take care of her," Batista told the Taunton Gazette. "They said that when she was there she was loved, and that was it."
Now Batista is upset and believes that the decision goes against the school's anti-discrimination policy.
Calls to school officials were not returned. However, a discrimination attorney said under the Americans With Disabilities Act "the law requires that reasonable accommodations be made available to people with varying disabilities."
The Department of Education says they are investigating the matter.
