Middlesex DA: Use of force in Watertown shootout justified

WOBURN, Mass. (MyFoxBoston.com/AP) - A Massachusetts prosecutor says it's "highly likely" that friendly fire critically injured a police officer during a gun battle with the Boston Marathon bombers days after the attacks.

But Middlesex District Attorney Marian Ryan said Tuesday that whatever wounded Massachusetts Bay Transportation Authority Officer Richard Donohue remains in his body and can't be examined to confirm. Her office's report concluded the gunfire was justified. No one will face any charges in connection with Donohue's shooting and it's likely we will never know who it was that shot him.

MBTA Transit Police Sergeant Dic Donohue released the following statement Tuesday, "While the District Attorney's report finds it likely that I was injured by friendly fire, it does not take away from the heroic actions of those officers who ultimately prevented further acts of terror on the citizens of the United States. Further, it remains clear that Tamerlan and Dzhokhar Tsarnaev are responsible for the firefight in Watertown. I harbor no regrets and am forever grateful to the police officers, firefighters, and medical professionals who saved my life on April 19th, 2013."

The gunfight took place days after bombs exploded at the 2013 marathon, killing three people and injuring over 260.

One of bombers, Tamerlan Tsarnaev, was killed. His brother, Dzhokhar, was eventually captured. A jury decided he should be sentenced to death.

The Massachusetts Emergency Management Agency concluded in a separate report that officers showed a lack of "weapons discipline," resulting in dangerous crossfire.
