Michelle Carter’s defense has officially filed a notice to appeal her conviction in the texting suicide case.
In June, Carter was found guilty of involuntary manslaughter in her boyfriend Conrad Roy's suicide. Carter was 17 when the 18-year-old Roy was found dead of carbon monoxide poisoning in 2014. The judge said that state had proven beyond a reasonable doubt that she acted recklessly and ultimately was responsible for his death when she told him to get back into the truck.

On August 3, Carter was sentenced to 2.5 years in prison. The judge said she will only serve 15 months with the rest of it suspended until August 2022. Carter’s lawyer asked to wait for her incarceration after the appeal process. Instead, they asked for probation first.
Judge Moniz granted the stay through the Massachusetts court.

Since there is no law in Massachusetts on assisted suicide Judge Moniz believed Carter’s case is worthy of appellate court wisdom.
