Commuter rail train conductor held without bail in Everett murder

MALDEN, Mass. — A commuter rail train conductor was ordered held without bail Thursday after he was arrested in connection with a deadly shooting in Everett.

Brian Green, 35, of Saugus, was arraigned in Malden District Court on a charge of murder in the death of 38-year-old Jarmahl Sutson.

Green, who is employed by Keolis, was arrested Wednesday in Reading.

In a statement, a Keolis spokesperson said, “We are reviewing his employment status and he will be placed on unpaid leave pending the disciplinary proceeding required under his collective bargaining agreement.”

Sutson, a Lynn resident, was shot and killed inside an apartment on Central Avenue on July 19, according to the Middlesex District Attorney’s Office. Police responded to the apartment around 4:22 a.m. and found Sutson with an apparent gunshot wound.

Prosecutors say Sutson previously had a relationship with Green’s ex-wife and they have a 10 year old child before she married Green.  Court documents indicate Green and his wife divorced and she was back with Sutson.  Middlesex ADA Suzanne Wiseman gave a summary of facts in the case. “This defendant was angry over the fact she went back to the father of the children. He expressed that anger in text messages,” said Wiseman. Prosecutors also described the scene where Green went in with a gun. “He had previously lived in that apartment, he still had key, there was no force entry,” said Wiseman, “traveled through a dark kitchen, down a dark hallway by two closed doors to the bedroom and shoot the person on the correct side of the bed”.

Sutson’s cousin, Michael Satterwhite, was in court and talked on behalf of the family. “That is something I had to prepare the family for. It’s all of 15 minutes but it opens up a lot of flood gates, a lot of emotions,” said Satterwhite.  Sutson’s cousin says they grew up with the Green family. “There was some family members of his here today and they apologized today but again its’ because we know each other,” said Satterwhite.

Green’s father is Kenneth Green, who is the Chief of the MBTA Transit Police according to the victim’s family who also knows the suspect’s family.

In a statement, an MBTA spokesperson said, “This is a personal matter for Chief Green and his family. The MBTA is confident in Chief Green’s leadership of the Transit Police.”

Brian Green is due back in court for a probable cause hearing on Sept. 7.
