ATTLEBOROUGH, Mass. (MyFoxBoston.com) -- An 18-year-old West Roxbury man is no longer facing a rape charge stemming from a July arrest at a Keith Urban concert.
The charge against Sean Murphy was dropped in an Attleborough District Court hearing Thursday.
"Given the state of the evidence, the case had to be dismissed in the interest of justice," Bristol County spokesman Gregg Miliote told the Boston Globe. "The family [of the woman] is on board with this decision."
Murphy's attorney Steven Brooks said because Murphy's encounter occurred with the woman in public at the Xfinity Center in Mansfield with bystanders looking on, it appeared that his client had been attacking the woman.
"It happened in a crowd and people saw it and assumed that because it was a young man on top of a young woman, and they both got up and went in different directions after, that it may have been a sexual assault," said Brooks.
Brooks said the encounter was consensual.
