MANCHESTER, N.H. — Adam Montgomery was arrested Monday morning for eight charges related to stealing firearms between September 29, 2019 and October 3, 2019 in Manchester.
The charges allege that Montgomery stole a rifle and a shotgun from the C.F. The charges consist of:
- two charges of theft by unauthorized taking for stealing the rifle and the shotgun,
- two charges of receiving stolen property for receiving or retaining the rifle and the shotgun,
- two charges of felon in possession for possessing the rifle and the shotgun after having been convicted of one or more qualifying felonies, and
- two charges of armed career criminal for possessing the rifle and the shotgun after having been convicted of three or more qualifying felonies.
One gun was recovered from Boston, another from Manchester, New Hampshire, but the third gun is still missing.
There is no evidence of any connection between the stolen firearms and the disappearance of Harmony Montgomery at this time.
“With the disappearance of Harmony Montgomery, Adam’s daughter, there’s been an intensive investigation into the Montgomery family, into especially around the time that she went missing. Their life, their pattern, things that were going on,” Jesse O’Neill, Sr. Assistant New Hampshire Attorney General told me. “In speaking to people, they’ve learned not only information related to the disappearance of Harmony, but also information about other things going on at that time, that’s sort of where that firearms theft investigation spiraled from.”
Because armed career criminal charges are special felonies, each one carries a minimum term of 10 years in State Prison and a maximum term of 40 years in State Prison. The theft and receiving stolen property charges each carry a maximum term of 7.5 to 15 years in State Prison, where the felon in possession charges carry a maximum term of 3.5 to 7 years respectively.
Montgomery was expected to be arraigned on April 6, 2022 at the Hillsborough County Superior Court, but Boston 25 News got the news that his Wednesday arraignment was canceled.
According to the DA, Montgomery filed waivers of arraignment and extradition as well as a bail agreement.
The new charges come while Adam Montgomery remains held at the Valley Street Jail, allegedly still refusing to tell investigators anything about Harmony’s whereabouts.
Adam Montgomery is charged with physically abusing Harmony.
I asked Jesse O’Neill if investigators believe that Harmony Montgomery is still alive.
“We’re keeping all options open. We’re treating this as a rescue mission, we’re investigating every lead, every source of information there is,” O’Neill told me.
