Attorney seeks to have OUI charge dismissed against judge's daughter

FRAMINGHAM, Mass. – The woman at the center of an investigation into an altered state police arrest report is scheduled to appear in court Friday when her attorney will ask for one of the charges to be dropped.

Alli Bibaud was arrested on Oct. 16 after allegedly swerving into a police construction detail on I-190 in Worcester. Bibaud, the daughter of Dudley District Court Judge Timothy Bibaud, told officers she was having an argument with a man in her car, which caused her to swerve.

Bibaud was arrested for OUI and drug charges, and during the arrest she allegedly made a comment referring to oral sex when she was asked about how she obtained the drugs she was accused of using.

The two troopers who wrote the report said they were ordered in by their superiors to redact that part of the police report or they would get fired. They are now suing the department.

Boston 25 News got a copy of the motion to dismiss the OUI-drug charge Bibaud is facing “based upon the fact that the commonwealth cannot prosecute two crimes for the identical offense conduct.”

“The result sought would result in this defendant being punished twice for the very same conduct were she to be convicted. That would result in an unjust and unfair result,” the motion says.

Former State Police Colonel Richard McKeon retired amid the investigation into the altered report, the second-in-command also stepped down.

Bibaud’s attorney has not returned phone calls from Boston 25 News, but a hearing is scheduled for Friday morning in Framingham District Court.
