An officer saw Jessie James around 12:25 p.m. driving a gray Infiniti sedan 70 mph in a 35 mph zone, the Northwest Indiana Times reported.

Investigators took James to a hospital to have his blood drawn. He recorded a blood-alcohol level of .41. The legal limit is .08.

When James stopped, the officer said the driver smelled of alcohol and his slurred speech was nearly indecipherable. James denied he was drunk.

“Jessie stated that he was not drunk and that if he was in fact a 0.41 he would not be alive,” investigators said in their report.

James was arrested and charged with driving while intoxicated, with a previous conviction, according to arrest records.
