CONCORD, NH (MyFoxBoston.com) – The man charged in the Abby Hernandez case is now set to appear in court Wednesday.
Nathaniel Kibby, the 34-year-old Gorham, N.H. man accused of kidnapping Hernandez, entered no plea during his arraignment last week and was held on $1 million cash bail. He was originally scheduled to appear in court of Aug. 12, but the date was changed due to an emergency motion filed by the defendant.
Kibby will be in court in Ossipee, N.H. on Aug. 6 at 1:30 p.m. for reasons related to the preservation of evidence, officials say.
He is charged with one count of felony kidnapping. Investigators allege Kibby "knowingly" confined Hernandez on Oct. 9, 2013 with the purpose of committing "an offense against her."
Hernandez returned home two weeks ago after being missing for nine months. She was last seen leaving her high school and walking down a nearby road. In December, when the teen was still missing, Kibby plead guilty to marijuana possession in a Conway court and paid a $350 fine.
