A lawsuit has been filed to release body camera video from a deadly police shooting this past March.
Video of Stephenson King’s death on March 11th in Roxbury is not being released, while Boston police officer Nicholas O’Malley waits for trial on manslaughter.
Civil rights lawyers are now suing Boston police and the Suffolk County District Attorney’s office for the video.
King was a carjacking suspect and O’Malley claims he fired in self-defense. O’Malley pleaded not guilty to the grand jury’s indictment, with his attorney stating that he was acting in self-defense after they say the suspect backed into a police cruiser.
Prosecutors say the shooting was excessive.
O’Malley is next back in court on Sept. 10 for discovery motions, and again on Dec. 8 for a mid-point pretrial hearing.
A final pre-trial hearing will be set at a later date with a presumptive jury trial date set for May 5, 2027.
