Driver who fatally hit Sherborn man in his yard was under the influence of alcohol, officials say

SHERBORN, Mass. — A 40-year-old Sherborn man was struck and killed in his yard by a driver now facing charges including driving under the influence, the Middlesex district attorney’s office said in a statement.

Sherborn Police responded to a report of a pedestrian crash on Goulding Street, East involving an Acura MDX around 4:42 p.m. Wednesday.

When officers arrived, they found the victim, Kevin Sullivan, 40 of Sherborn, who was pronounced dead at the scene, the district attorney’s office said.

The driver of the vehicle, identified as 37-year-old Joshua Patel of Mansfield, was arrested and was expected to be charged with driving under the influence and additional charges in connection with the fatal crash.

Patel was arraigned in Natick District Court on Thursday on charges of motor vehicle homicide by operating a vehicle under the influence of alcohol, assault and battery, reckless operation of a motor vehicle, speeding and a mark lanes violation.

He was transported to a local hospital for evaluation..

A preliminary investigation found that Patel had been traveling eastbound on Goulding Street East at high speed when he lost control of his car, exiting the travel lane on the westbound side of the road and subsequently allegedly struck Sullivan while he had been working in his yard. Patel also continued across the lawn, striking a car that had been parked nearby.

Officers noticed Patel was impaired and arrested him, the district attorney’s office said.

Patel’s bail was at $20,000 and ordered by the judge not to drive, not to consume any alcohol, submit to random screens via a SCRAM and stay away from and have no contact with the witnesses. His next court date is scheduled for Dec. 3.

The fatal crash is being investigated by the Middlesex District Attorney’s Office, Sherborn Police and the Massachusetts State Police Crash Analysis and Reconstruction Section.
