BOURNE, Mass. — A high school football captain faced a judge Friday on charges of assault in Bourne, Massachusetts.

John Allen, 18, is a senior at Upper Cape Cod Regional Vocational and is charged with assault and battery, strangulation and suffocation on a 14-year-old girl.

Police say Allen attacked the 14-year-old at a bus stop.

Defense attorney John Glynn argued police have the wrong man in custody, but prosecutors say Allen is the right guy after investigators found the clothes Allen was wearing during the time of the attack.

“Inside the vehicle was a maroon, hooded sweatshirt, with white lettering, with long black hair on it. Which matches the type of hair, the victim in this case,” the prosecutor said.

The 14 year old girl was walking to the school bus stop on Puritan and Cranberry Roads in Bourne when she was attacked last Thursday. She told police she was attacked from behind.

A witness called out the victim's name and Allen allegedly got spooked and took off in his car.

"Several different descriptions of the vehicle in question, suggest that all of which are different," Glynn said in court.
Glynn said the witness couldn't even give police an accurate description of the suspect.

“This is a case where identity is clearly an issue here,” said Glynn.

Glynn said his client is a captain of the football team, works at an auto body shop and has had a girlfriend for the last year. Glynn and Allen's mother say he’s a good kid.

“Please be respectful of my privacy and my son’s privacy,” Allen’s mother said after court Friday.

Allen is being held without bail pending a dangerousness hearing on Tuesday.

FOX25 spoke with the victim, she told us she has no idea who Allen is.
