DA Cruz fires back over pay-to-play lawsuit

(MyFoxBoston.com) -- Plymouth County District Attorney Timothy Cruz said in court papers that allegations that prosecutors in his office were pressured to donate to his campaign were false and instead made by a disgruntled former prosecutor who was fired for incompetence.

The response, filed last week in U.S. District Court, comes in response to a lawsuit filed by former Plymouth prosecutor John Bradley, who sued the DA and two top lieutenants, saying he was fired after he stopped making contributions to Cruz's campaign committee. Bradley claimed his previously good relationship with Cruz as well as top prosecutors Michael Horan and Frank Middleton took a turn for the worse after he refused to contribute.

But the response filed by Cruz and his deputies, who are being represented by a specially appointed state assistant attorney general, paints a different picture of the disgruntled former prosecutor.

"(H)is termination from the District Attorney's Office has nothing to do with his alleged political activities and everything to do with his systematic and gross insubordination, unprofessional behavior and declining job performance," the document says.

But the DA's office, in a statement to the media, said the suit contained "numerous factual errors and misstatements," including his misstating what year he became he an assistant district attorney and that he was carrying a heavy caseload for a period of time when he was not.
