Man accused of kidnapping, sexual assault indicted on new charges

Victor Peña's case will move to the Suffolk Superior Court after the Suffolk County Grand Jury added new charges following the alleged kidnapping and sexual assault of a 23-year-old woman.

The jury returned indictments charging the 38-year-old Charlestown man with one count of kidnapping and 10 counts of aggravated rape for allegedly holding the woman against her will and sexually assaulting her at his home on Walford Way in January.

The victim was kidnapped after leaving a Boston bar, and was found days later at the suspect's Charlestown apartment.

The indictments move Peña's case from the Charlestown Municipal Court to the Suffolk Superior Court, where the Suffolk County District Attorney's Office said it will be adjudicated.

A psychiatric evaluation at Bridgewater State had found Peña mentally sound, leading a judge to rule him competent to stand trial.

Peña's brother has challenged the allegations ever since the incident happened, saying his brother, a father of two, has cognitive issues.

"I don’t really believe it, I believe this was mutual, they went together," said Jose Peña. "He’s not an aggressive person, that’s for sure. He might not be the smartest, but he’s definitely not a criminal."

His Superior Court arraignment is tentatively scheduled for March 20, and he is being held without bail.
