WEST PALM BEACH, Fla. — Florida prosecutors are appealing a judge's order that prevents them from using surveillance video from a day spa at the center of a prostitution sting that led to charges against New England Patriots owner Robert Kraft.

A judge on Monday said police illegally obtained the video, which allegedly shows Kraft paying for sex acts in the Orchids of Asia Day Spa in Jupiter, Florida back in January.

The video is key evidence against Kraft, who is charged with two counts of soliciting a person for prostitution.

Police say Kraft solicited a prostitute at the day spa just hours before the AFC Championship game in January.

The appeal will be heard by the Florida Circuit Court.

No hearing date has been set.
