Barstool founder could be in legal trouble over anti-union tweets

BOSTON — Barstool founder Dave Portnoy may be in hot water over his latest Twitter rant.

In response to the staff at rival Bill Simmons' publication 'The Ringer' unionizing, Portnoy took to Twitter to voice his distaste for unions.

When a writer for another publication tweeted his support for Barstool employees interested in learning more about unionizing, Portnoy directly threatened to fire anyone who took him up on his consulting offer. Then he took it a step further and threatened to fire anyone who would unionize.

According to the National Labor Relations Board, employers can neither encourage nor discourage employees from union activities "by discrimination in regard to hire or tenure of employment or any term or condition of employment."

The NLRB says companies are prohibited from laying off or disciplining employees because they are pro-union.
